Rusty Bucket Floristry (ABN 575 6809 1443) owns and operates the Rusty Bucket Floristry business and the website rustybucket.com. As a visitor or a customer on our website you agree to all terms, conditions and disclaimers by accessing, browsing or using this website. Terms and conditions may be amended at any time and will be effective immediately. This online merchant is located in Brisbane, Australia.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1.0 PRICING AND PAYMENT

The price is clearly displayed on the shop pages, the price may change without prior notice but will be clear prior to any purchase.

The price of delivery will be calculated at the checkout point and is dependent on delivery location (refer to 3.0 DISPATCH AND DELIVERIES)

The price displayed is inclusive of GST and is in Australian dollars (AUD).

We accept online payment by Visa and Mastercard. At this point in time, we can only offer a limited range, we apologies for any inconvenience.

Our prices on this website are inclusive of GST and are clearly displayed on each product. Due to fluctuation in market availability, prices may change from time to time without prior notice but will be clear for you to
see before you purchase.

2.0 SUBSTITUTIONS

The Rusty Bucket team designs each and every flower order in a unique manner. Utilising our experience in colour matching, design and presentation. Our
team utilises premium flowers straight from our suppliers, using different types of flowers and foliage within your colour palette selected. This allows us to create all your arrangements and bouquets beautifully different. If we need to substitute a sundry item i.e., vase, fragrance, foxtail or anything else, you will be notified via phone or email. 

3.0 DISPATCH AND DELIVERIES

The Delivery free relating to the specified address is calculated at the checkout point and is added to the total before payment is made.

Orders placed before 12pm for same day delivery will arrive between 10am and 3pm. Orders placed in advance will arrive between 10am and 3pm on the
nominated delivery date.

Our drivers will attempt to deliver the flowers to the intended
recipient. If they are unavailable, we will leave the flowers at, or near, the door of the address provided. If it appears unsafe (i.e. possible theaft, damage or no shelter from extreme weather conditions) to leave the flowers there, we will contact the sender and or recipient to re-arrange delivery. In the instance a redelivery needs to occur there will be an additional charge of $20 per re-delivery. Either the sender or the recipient will be required to pay this amount to Rusty Bucket Floristry before the redelivery will occur. Please help us by ensuring someone will be available to collect the flowers or it is a safe delivery address. We want the beautiful flowers you have bought to be delivered as intended.

For business, school, hospital addresses, we will attempt to deliver to the specified details provided. It is however common that the flowers will be delivered to the front desk or reception and directed to the recipient from there. We are happy to deliver but cannot take responsibility if they do not
collect or are not delivered from there.

Rusty Bucket Floristry does not offer a track and trace service or
estimated time of arrival. Proof of Delivery (POD) times are vailable, if requested.

We currently deliver to suburbs within a 10km radius of Samford Valley. I.e, Samford Valley, Samford Village, Mount Nebo, Mount Glorious, Ferny Grove,
Ferny Hills, Arana Hills, Mitchelton, Yugar, Draper, Albany Creek, Closeburn, Cedar Creek, Clear Mountain, Dayboro. Please call us if you wish to deliver to
Oceanview or Mount Mee.

If you do not see your suburb on the list above, please call the team on 289 6420, to enquire about your delivery.

This is subject to change and will be updated on our website as the
changes occur.

4.0 PRE-ORDERS

We offer our customers the ability to order our beautiful bunches in advance, to be delivered on the day of your choosing.

For orders over $80 we highly recommend you pre-order, so that our team can ensure your arrangement can be made to meet your design expectations.

5.0 DAYS OF OPERATION

Rusty Bucket Floristry offers our delivery service Monday to Friday
between 10am and 3pm and are open on Saturdays for collections from 9am to 3pm. Except for public holidays or over the Christmas, New Year and Easter period. Flowers cannot be sent on these days.

Flowers ordered on or for delivery on weekends, public holidays or over the Christmas, New Year and Easter Holiday periods will be sent to the
recipient on the next available day.

6.0 CUSTOMER OBLIGATIONS

6.1 CONTACT DETAILS

Customers must supply a valid phone number and contact email.

Rusty Bucket Floristry accepts no liability arising out of failure to
contact a customer, where the contact details have not been supplied, are invalid or incorrect.

6.2 DELIVERY ADDRESS

It is the obligation of the customer to ensure the recipient’s delivery address is correct.

Failure to provide the correct delivery details may result in
incorrectly delivered goods, undelivered goods and additional redirect or
redelivery fees. Our standard price for re-delivery is $20 and the address for redelivery must be within our delivery range.

Rusty Bucket Floristry accepts no liability should the goods be incorrectly delivered and our delivery driver acted reasonably when delivering the flowers.

Once delivered in accordance with your instructions, the product becomes the responsibility of the customer.

Timed Deliveries

Rusty bucket Floristry will make every attempt to accommodate your request, but timed deliveries cannot be guaranteed.  Deliveries will, however, be delivered on the date you have selected, by 5pm for businesses and m for residential addresses. Our team will try our hardest to accommodate your needs. Call in advance to organise preferred delivery time.

Hospitals and Schools

For school and hospital addresses, we will attempt to deliver to the specified details provided. However, it is quite common that the flowers will
be delivered to the front desk or reception and from there are directed to the recipient by the staff members of the facility. We are happy to deliver to all schools and hospitals but cannot take responsibility if they do not collect or are not delivered from there.

Please note: Most wards do not allow delivery personnel into rooms and schools do not allow delivery personnel into the school. 

For Hospital Delivery - please check the hospital for a ward
number and if the recipient is in ICU. Patients that are in ICU cannot have flowers and plants in their room. In this case the items will be returned to the shop, and you will be notified for an alternative address. Which will incur an additional delivery cost to the customer.

Please note - The Royal Children's Hospital has an anti-pollen policy so flowers will not be accepted. They also have policies that include the banning of nuts and latex balloons.

If the delivery is rejected from the hospital, the delivery cost to the hospital will not be refunded if items are return to the shop.

6.3 RECIPIENT DETAILS AND PERSONALISED MESSAGES

The customer must ensure recipient details, such as their name and address are correct and are also spelt correctly. We do not accept responsibility for any incorrect information when such information results from
a reliance on information provided by the customer.

The customer must also ensure that the recipient will be home or that they are comfortable with Rusty Bucket Floristry to deliver as close to the front door as possible. Please help us and be specific in the special delivery
instructions section of the website.

In relation to the personalised message, the customer must ensure it is written to their satisfaction, we do not accept responsibility for incorrect
spelling or grammar.

7.0 ALTERATIONS
AND AMENDMENTS TO ORDER

For same day deliveries, Rusty Bucket Floristry cannot provide any alterations or amendments (including cancellations) for orders that have already been prepared and/or are in transit. The customer must ensure that the details of the order are correct prior to finalising the order.

If we are requested to redeliver due to an incorrect address, we will make every attempt to help rectify the situation. We may charge an additional $20
for the redelivery of flowers or to deliver to a different address from that originally advised. Please contact us on 3289 6420 or hello@rustybucket.com.au

For orders made in advance (pre-order) we are able to make changes to the order if details are provided up to 24 hours before the day of delivery. Amendments accepted by Rusty Bucket Floristry are changes to the personalised message and delivery address. This however assumes that both are in accordance with our terms and conditions.

Rusty Bucket Floristry reserves the right to refuse alterations and
amendments.

8.0 CANCELLATION OF ORDER

Given the nature of the business we operate, Rusty Bucket Floristry cannot cancel orders that are
already prepared and/or are with a courier for delivery.

Cancellation requests received within 24 hours prior to the scheduled date of delivery
within Australia, will incur an administration fee of $15.00.

If the cancellation is authorised the difference will be refunded, within 3 – 5 working days, or at
the discretion of Rusty Bucket Floristry’s bank / financial institution.

Changes and cancellations to orders more than 24 hours prior to the delivery day will be
accepted. Either a refund will be issued depending on the reason or a new delivery date will be organised.

After this, we are unable to offer a refund and a store credit will be issued to you.

9.0 COMPLAINT AND RETURNS POLICY

Dissatisfaction can be communicated with us at any point in time. Please be advised however that we do request photos of the original product(s) to assist in understanding the
complaint. The Rusty Bucket Floristry team will do our best to address the issue and rectify the situation within our means.

As each flower is unique, so too, are your special requirements and concerns surrounding your order. For that reason, we ask that you please call us directly on 07 3289 6420 to discuss any queries or concerns you may have in relation to your flowers sent or received. Direct contact with our team is required within 24 hrs of flowers/gifts sent or received. A number of resolutions may be available to you and are subject to your particular situation.

Regretfully, we cannot arrange a resend of fresh flowers or refund if the original flowers delivered/received are disposed of, thereby making them unavailable for our team to assess the cause of the problem. Therefore, we do require a clear
image of the entire flower bouquet or arrangement in question.

As flowers are perishable, we are unable to replace/refund flower orders due to a simple change of mind. If there is a problem with quality of flowers sent or received, we require a phone call immediately (within 24hrs).
This is not what we wish for and pride ourselves on our premium flowers and their great quality. 

A refund will not be issued if you cannot provide us with a clear image of damage to product. No
refund will be issued for a change of mind.

Note: All agreed refunds for orders placed online will be refunded back to the payment
method used and a confirmation email will be sent to the email provided. Orders over the telephone are credited back the original credit card on which the
order was purchased. Refunds for in-store purchases may be processed through the original credit card for which the order was purchased or by EFTPOS only. A voucher to the same amount paid will be issued for all cash purchases.

10.0 TRADEMARKS, COPYRIGHTS AND RESTRICTIONS

All materials on our website is owned, operated, licensed or controlled by Rusty Bucket Floristry, this includes images, illustrations, audio clips, and video clips and is protected by our intellectual property rights.

Material on our website is solely for your personal, non-commercial use. Such material may not be copied, reproduced, republished, modified, uploaded,
posted, transmitted, or distributed in any way, including by e-mail or other electronic means, without the express prior written consent of Rusty Bucket
Floristry.
