Self-service Wedding Florals Collection
1. ACCEPTED PAYMENT METHODS
Payments must be made through the website portal. Visa, Amex and Mastercard are all accepted.
2. RESERVATION OF SERVICES
Our team will not hold your date based on phone call, email or in person enquiries. Once you have purchased your wedding florals through the website your date is secured.
3. PLANNING AND COMMUNICATION
The price of floral piece selected includes the time allocations for research, design, proposal revisions and all communications involved to achieve the desired floral plan. The client is eligible for two confirmation emails and/or one phone call.
If any extra planning time is required, Rusty Bucket Floristry may charge for the extra planning time (i.e., per hour required). This will be clearly communicated to the client through an email before the extra hours are executed. Extra planning time may include extra revisions or additional logistical planning.
4. SERVICE RESTRICTIONS
The main difference between “Self-Service Wedding Florals” and “Full-Service Wedding Floral Design”, is the elimination of the administration fee and on the day labour. Because of this your communication and planning time with the florist is reduced.
Our team is bound by seasons, availability at the wholesaler and allocated planning time (see item 3. Planning and communication). Therefore, we cannot guarantee specific flowers but will choose the best seasonal blooms that match your chosen colour palette and style.
The RBF team reserves the right to make substitutions if the flowers received are
not of the quality suitable for your wedding/event. If this situation occurs, the integrity of the proposed colour scheme will be honored, and flowers of equivalent value will be used in substitution.
If a substitution needs to be made within the week before your reserved date the florist team does not need to notify you of the substitution.
5. ADDITIONS TO QUOTE
You may add on floral items to your order at any point. The client may do this through the website or can be issued an additional invoiced depending on the item desired. The cut off time is 36 hours before the reserved date. This allows the florist enough time to contact the grower or wholesaler to add on to the order.
After the money has been paid the total cannot be decreased. It can, however, be reallocated or held as a credit in store.
All changes must be communicated through email and accepted by Rusty Bucket Floristry through an email.
6. DELIVERY AND PICKUP
Addresses, times and designated persons will be confirmed by the florist handling your order. Please
ensure that you give us the correct information.
Delivery Conditions: The delivery fee is determined is calculated automatically at the checkout. This price
is calculated based on the distance between Samford Valley and your selected
location within a 20km radius.
If you will not be available during the elected delivery time, a designated person will be required to meet the florist at the location of drop off. This is to ensure that all items are delivered and accounted for. The team member delivering the flowers from the Rusty Bucket Floristry will not be held responsible for any damages that may occur if there is not a designated person to sign for the delivery.
Pickup Conditions: If the client as selected pickup at the checkout, not additional fees will be added. The florist assigned to your order will confirm the name of the person collection the order, pick up time and date of collection.
7. CHANGE OF MIND and/or CANCELLATIONS
The Rusty Bucket Floristry team acknowledges that situations can arise in which alter your original design/quantity requirements. Design changes must be communicated to the team as soon as possible through email. The Floral Designer will then converse with the Director to understand if your case is eligible for the proposed changes.
The Rusty Bucket Floristry team acknowledges that situations can arise in which you must cancel the services requested for the booked date. Cancellations made under this contract are not eligible for a refund. The total of monies paid will be held for you as a store credit for one year, starting at the payment date.
In extreme circumstances, the Director will look at the client’s case to determine
whether they are eligible to receive a 70% refund of total monies paid. 30% will be held as an acting deposit and includes the administration work completed.
8. POSTPONEMENT
The Rusty Bucket Floristry team acknowledges that situations can arise in which you must rescheduled the requested booking date. Due to limited availability, the team requests that you notify us of your need to reschedule with adequate notice through an email.
As part of this agreement, you can make one postponement request. If you require another postponement an added 20% of the total price may be added. The team will communicate this to you before an invoice is issued.
9. INCAPACITATION
In the event a member(s) of Rusty Bucket Floristry is incapacitated, the Director, Zoe McGarry will make every endeavor to contract external florists to fulfill our contractual obligations.
If in the event a substitute team cannot be provided, you will receive a full refund of (limited to) all monies paid.
10. FORCE MAJEURE
A party will not be considered in breach or in default because of, and not will not
be believable to the party for, any delay or failure to perform its obligations under this agreement by reason of, fire, earthquake, flood, explosion, strike, riot, war, terrorism, pandemic, or similar event beyond that party’s easonable
control (each a “Force Majeure event”). However, if a Force Majeure Event occurs,
the affected party shall, as practicable: (a) notify the other party of the Force Majeure Event and its impact on performance under this agreement; and (b)
use reasonable efforts to resolve any issues resulting from Force Majeure Event
by rescheduling Event said date and continue obligations under this agreement.
11. PROMOTIONAL RIGHTS
The client hereby grants Rusty Bucket Floristry the limited perpetual right to use,
publish, and exhibit on the internet and or in other publications, any digital
images or photographs of the event taken at the event and details of the event,
solely to promote Rusty Bucket Floristry.
The client hereby grants Rusty Bucket Floristry the right to take photos and videos on the day and at the location. The right to privacy will be respected.
Rusty Bucket Floristry will credit other vendors when appropriate i.e., photographer, models, venue, fashion labels etc.
12. LIMITATION OF LIABILITY
In the event you have a dispute, Rusty Bucket Floristry is not liable for more than the total of monies paid in relation to this contract.
As a client of Rusty Bucket Floristry, you acknowledge, understand, and agree that our business, employees, partners and subcontractors shall not be liable to you for any punitive, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages which may be related to the
loss of any profits, goodwill, use, data and/or other intangible losses.
13. BREACH OF AGREEMENT
Our business firmly believes that a good client and business relationship is based

If you believe that we have breached this Agreement and want to make a complaint
about that breach, please contact us using the details set out. If you are
unsatisfied with our response, the Office of the Australian Information
Commissioner may be able to assist you with a review of our decision. Contact
the OAIC for more information.
14.
DISPUTE RESOLUTION
If
a dispute arises out of these conditions, we ask that you contact us in the first instance, and we will do our best to resolve the issue to our mutual satisfaction efficiently. If we are not able to resolve it within 30 days, we will go to mediation in Brisbane, Queensland (unless parties and the mediator
agree that the location is inconvenient and are unable to agree on a suitable
alternative location, in which case the parties may agree to participate in online mediation) and split the costs of that equally. If the dispute still is not resolved within 30 days of the mediation, either party may ask the mediator
to terminate the mediation.
Each party agrees that we will not commence any proceeding in a Court or Tribunal until we have complied with this clause (unless of course we are seeking interlocutory relief).
All communications made by the parties arising out of this dispute resolution clause are confidential and to the maximum extent possible, must be treated as “without prejudice” negotiations
for the purpose of applicable laws of evidence.
Agreement
Each party shall use reasonable efforts to take, or cause to be taken, all actions
necessary or desirable to consummate and make effective the transactions this agreement contemplates
or to evidence or carry out the intent and purpose of this agreement.
This agreement contains the entire understanding between and Rusty Bucket Floristry it
supersedes all prior and simultaneous agreements between the parties.
